Deceased User and Inheritance Policy

Review the verification, estate, KYC, government-confirmation, fund-release, account-closure, and data-retention process for a deceased RutoWallet user.

This Deceased User and Inheritance Policy explains how RUTO AI LIMITED reviews requests concerning the RutoWallet account, information, or eligible assets of a user who has died.

RutoWallet is a custodial cryptocurrency wallet and virtual card product. Protecting a deceased user's estate requires a controlled legal, identity, security, sanctions, anti-money-laundering, fraud-prevention, tax, and regulatory review. A family relationship, nomination, will, or possession of the deceased user's device or credentials does not by itself authorize account access, disclosure, transfer, closure, or deletion.

This policy should be read with the Privacy Policy, Data Deletion Policy, Terms of Service, Risk and Compliance Disclosure, Card Terms, and the laws governing the deceased user's estate and the person making the request.

Who May Submit a Request

A request may be submitted by an executor, court-appointed administrator, lawful personal representative, estate trustee, or another person who can establish legal authority or a legally recognized entitlement under the applicable succession or inheritance law.

Being a spouse, child, parent, sibling, beneficiary, next of kin, or other family member may be relevant evidence, but family status alone does not establish authority to control the account or receive assets. RutoWallet may require the claimant to obtain probate, letters of administration, a succession or inheritance certificate, a court order, or an equivalent official grant before the request can proceed.

How to Start a Request

The claimant or the claimant's authorized legal representative must contact legal@rutowallet.com with the subject Deceased User Estate Request. The initial message should identify the deceased user's full name and registered RutoWallet email address, the date and country of death, the claimant's full name and relationship or legal capacity, the relevant jurisdiction, and a safe method for further contact.

Claimants should not email passwords, one-time codes, passkeys, authenticator codes, transaction passcodes, private keys, seed phrases, or unnecessary original documents. RutoWallet will provide instructions for secure document submission and verification after the request is opened.

Official Documents and Proof of Authority

RutoWallet may require original, certified, notarized, apostilled, legalized, translated, or independently verifiable copies of documents, depending on the issuing country and applicable law. Required evidence may include:

  • An official death certificate or equivalent government-issued death record
  • A grant of probate, letters of administration, succession certificate, inheritance certificate, court appointment, court order, or equivalent official proof of authority
  • The will and any codicils, where legally relevant, together with proof that the instrument has been accepted or validated by the competent authority where required
  • Government-issued identity and address documents for the claimant and, where applicable, other executors, administrators, trustees, or beneficiaries
  • Official civil-status or family-relationship records where relationship is legally relevant
  • Estate, beneficiary, tax, banking, wallet-destination, indemnity, legal-opinion, or authorization documents reasonably required for the case
  • Certified translations where a document is not in a language RutoWallet can review

RutoWallet may reject, pause, or request replacement documents that are incomplete, expired, inconsistent, altered, unverifiable, issued by an authority without jurisdiction, or otherwise insufficient to establish death, identity, authority, or entitlement.

Claimant KYC and Compliance Verification

Every person proposed to control the request or receive eligible assets must complete the KYC and compliance checks required by RutoWallet. This may include collection and verification of legal name, date of birth, nationality, residential address, government identification, facial or liveness verification, contact information, tax information, occupation, source of funds or wealth where relevant, sanctions and politically exposed person screening, and any enhanced due diligence required by the risk or jurisdiction.

KYC completion does not by itself prove inheritance entitlement or guarantee fund release. The claimant must separately establish valid legal authority, and RutoWallet may repeat or refresh verification before taking action.

Government and Authority Confirmation

RutoWallet may independently contact or seek confirmation from the government body, civil registry, probate registry, court, notary, embassy or consulate, tax authority, law-enforcement body, regulator, document issuer, or other competent authority connected with the case. RutoWallet may also use lawful verification providers and request confirmation through official channels.

RutoWallet will not release eligible assets, disclose protected account information, transfer control, or complete account deletion until it is satisfied that the death, documents, claimant identity, legal authority, beneficiary or estate entitlement, destination, and required compliance checks have been verified. If an authority does not respond, cannot verify the documents, or identifies a conflict, the request may remain pending, be restricted, or be declined.

Account Protection During Review

After receiving credible notice of a user's death, RutoWallet may restrict sign-in, transactions, cards, conversions, withdrawals, transfers, account changes, deletion, or other activity to protect the estate and prevent unauthorized access. Existing credentials must not be used by a family member or claimant to impersonate the deceased user.

RutoWallet may preserve relevant balances, transaction records, device and access records, communications, KYC information, and compliance evidence while the request is reviewed. Restrictions may remain in place during disputes, investigations, court proceedings, sanctions reviews, tax reviews, provider reviews, or government verification.

Review Outcomes and Release of Eligible Assets

After satisfactory verification, and only where legally and operationally permitted, RutoWallet may transfer eligible assets to an estate-controlled or otherwise lawfully authorized destination, facilitate another legally permitted settlement method, close the account, or take another action required by a competent authority. RutoWallet will not transfer ownership of the deceased user's login credentials or permit another person to operate the account as though they were the deceased user.

Any release may be subject to outstanding debts, fees, negative balances, pending transactions, chargebacks, disputes, liens, taxes, sanctions, court orders, provider restrictions, network requirements, unsupported assets, frozen or stolen-fund reviews, and other lawful claims or controls. Blockchain transfers are generally irreversible, so destination ownership and authority may require additional verification.

A will or beneficiary instruction will be considered only to the extent it is valid and effective under the applicable law. If multiple people make competing claims, the estate is disputed, or documents conflict, RutoWallet may maintain restrictions until the claimants obtain a final court order, joint lawful instruction, settlement, or other conclusive authority acceptable under applicable law.

Timing

There is no guaranteed service timeframe for completing a deceased-user or inheritance request. The review may remain open for as long as reasonably necessary to receive complete documents, finish KYC and enhanced due diligence, obtain government or judicial confirmation, resolve disputes, satisfy provider requirements, and comply with applicable law.

RutoWallet is not responsible for delays caused by claimants, courts, registries, governments, embassies, notaries, regulators, law-enforcement bodies, verification providers, blockchain networks, service providers, or conflicting claims. Where applicable law imposes a mandatory response or processing deadline that cannot lawfully be excluded, RutoWallet will act in accordance with that requirement.

Different Rules by Country or Region

Succession, probate, inheritance, estate administration, marital property, taxation, digital assets, privacy, sanctions, and financial-services rules differ across countries and regions. RutoWallet will apply the requirements relevant to the deceased user, claimant, estate, asset location, company obligations, and involved providers. Additional local documents, court recognition, legalization, translations, tax clearance, regulatory approval, or professional legal opinions may be required.

RutoWallet may decline or be legally unable to process a request in a jurisdiction where the service, claimant, transfer, asset, or destination is prohibited or unsupported, or where the evidence does not meet applicable requirements.

Privacy and Permitted Disclosure

RutoWallet protects the deceased user's account information and the personal information of claimants, representatives, and beneficiaries. Information will be collected, used, retained, and shared only as reasonably required to verify and administer the request, protect the estate, prevent fraud, comply with law, establish or defend legal claims, and coordinate with competent authorities and service providers.

RutoWallet may limit information provided before authority is established. Nothing in this policy requires disclosure that would violate privacy, financial secrecy, sanctions, law-enforcement restrictions, court orders, another person's rights, or other legal obligations.

Account Closure, Deletion, and Record Retention

Account closure and data deletion are separate from release of eligible assets. RutoWallet may first settle, restrict, or transfer eligible assets and resolve outstanding obligations before closing the account. Deletion will be handled under the Data Deletion Policy and applicable law.

Even after closure or an approved deletion request, RutoWallet and relevant providers may retain identity, KYC, estate, authority, beneficiary, transaction, blockchain, tax, accounting, audit, sanctions, anti-money-laundering, fraud-prevention, dispute, security, and legal records for the period required or permitted by law.

RutoWallet does not determine who should inherit an estate and does not provide legal, probate, inheritance, or tax advice. Claimants are responsible for obtaining independent professional advice and the official authority required in every relevant jurisdiction. This policy does not override a valid court order or any law that cannot be excluded by contract.

This Deceased User and Inheritance Policy is effective as of August 22, 2026.
